General

References to “we”, “our” or “us” in the Insurer Terms and Privacy means AWP P&C SA. The purpose of the present notice is to define the Insurer Terms & Conditions under which we make the application available to users and the conditions under which users may have access to and use the application.

By accessing the application and using its content, you acknowledge and agree that you have read and understood the following terms and conditions of use, which we reserve the right to modify or update at any time, and agree to be bound by them.

Do not use the application if you do not agree with these terms of use.

The insurer is AWP P&C SA, registered as a foreign company in England and Wales with foreign company FC030280, with registered office located at 7 Rue Dora Maar, 93400 Saint-Ouen, France.  AWP P&C SA acts through its UK branch AWP P&C, registered in the United Kingdom as a branch of AWP P&C SA (registered branch number: BR015275, registered office: 102 George Street, Croydon, Surrey CR9 6HD).

 

Applicable law

In the event that any provision of these terms is held illegal, void, or unenforceable, the validity or enforceability of the remaining provisions will not be affected, and the unenforceable provision will be replaced with an enforceable provision that comes close to the intention underlying the unenforceable provision.

 

Privacy

You should read carefully the full Privacy Statement before using the application, as it is incorporated into these terms and conditions by reference, and governs our treatment of any information, including personally identifiable information you submit to us.

 

 

Privacy Statement

We are committed to keeping your information confidential and secure. We have developed and implemented procedures to ensure that your privacy is safeguarded, at all stages of our relationship. You are protected not only by the applicable data protection and privacy laws, but also by our commitment to safeguard your privacy and your right to decide how your personal information will be used.

When you submit claims via the mobile application, please be aware that you are submitting personal information and you will not be informed separately of our Privacy Statement.

The information you provide to us will be held in accordance with applicable data protection law.  References to information includes personal information given by you to us through this healthcare app, in your Application, Claim or Treatment Guarantee/ Pre-Authorization Form and/or supporting documents/information we collect in connection with products or services we provide.  We are the data controller for this information.



Uses

Personal Information you supply may be used for the purposes of claims administration (including underwriting, claims handling, reinsurance and fraud prevention) by us. We may use third parties to process data on our behalf. Such processing is subject to contractual restrictions regarding confidentiality and security in line with applicable Data Protection obligations.


Sensitive data

We need to collect sensitive data relating to you (e.g. health details), to assess insurance terms and/or administer claims.


Disclosure of information

We may share your information with our agents, group companies, other insurers and their agents, service providers, any intermediary acting on your behalf or governing/regulatory bodies (of which we are a member or by which we are governed). In certain circumstances, we may use private investigators to investigate a claim you have submitted.


Retention

We are obliged to retain your records for seven years from the date the insurance relationship ends, subject to any local restricitions which may apply. We will not retain your data for longer than necessary and will hold it only for the purposes for which it was obtained.


Representation and Consent

By your certification you confirm that you have the authority to act on behalf of your dependants in respect of all personal information you provide to us, and that you consent to the disclosure, processing, usage and retention of this information in relation to yourself and on behalf of your dependants.


Right of access and the update of information

We respect your privacy rights, particularly your right to access your information. If you ask us, and to the extent provided by local law, we will provide you with a copy of this information. We strive to keep your data accurate, complete and up to date. Regarding your personal information, please provide details of any changes or corrections that are required by calling our Helpline.


Changes to our Privacy Statement

We reserve the right to update this Privacy Statement from time to time, at our sole discretion. If we make any changes, we will post those changes here. Your continued use of the mobile application after we post any updates will constitute your acceptance of those updates.
